Conditions |

| Customers
must abide by these Terms and Conditions at all
times. Violation at any
time will result in
Waverly Hall Telephone, LLC terminating your Service
Agreement. |
| 1.
Customers may not resell the Service, use it for
high-volume purposes, or engage in similar activities
that constitute resale (commercial or non-commercial),
as determined solely by Waverly Hall Telephone,
LLC. |
| 2.
Customers may not use the Service to host a dedicated
or commercial server. |
| 3.
Waverly Hall Telephone, LLC reserves the right to
audit connections electronically to enforce these
and other provisions of the Service Agreement. |
| 4.
The Service may not be available at the rates, speeds,
or bandwidth generally marketed or stated; and,
some telephone lines may not qualify for the Service.
Waverly Hall Telephone, LLC cannot guarantee the
defined speeds and availability of Service at all
times. |
| 5.
Customers who have signed a contract and do not fulfill the twelve (12) month
term commitment after signing the Service Agreement
will be required to pay Waverly Hall Telephone,
LLC $15.00 for each month or partial month remaining
to complete the twelve (12) month term of the Agreement
(referred to as the Termination Fee). Customers
who choose to terminate the Service Agreement early,
before the end of the twelve (12) month term, will
also be liable to pay Waverly Hall Telephone, LLC
the full cost of the modem ($125) if not returned. |
| 6.
Waverly Hall Telephone, LLC reserves the
right to deny or discontinue the Service at any
time, without notice, in the event customers fail
to pay their bill, or supply Waverly Hall Telephone,
LLC with a credit card that is denied or expired.
Waverly Hall Telephone, LLC may also deny or terminate
Service if a customer’s use (or additional
users on your account) is illegal, objectionable,
inappropriate, or unlawful in nature. |
| 7.
Waverly Hall Telephone, LLC has no responsibility
for, and no control over, the information or materials
customers access through the Internet, as a result
of using the Service. Waverly Hall Telephone, LLC
cannot protect the customer from malicious, destructive,
or contaminating infections or viruses as a result
of using the Internet and/or downloading files through
this Service. Customers are responsible for taking
security precautions and exercising caution when
accessing external data or files. Likewise, Waverly
Hall Telephone, LLC is not responsible for ANY loss
of time or revenue resulting from a Service outage
or problems resulting from the aforementioned use
of this Service. |
| 8.
By installing or through the use of this
Service, Waverly Hall Telephone, LLC is in no way
responsible for or liable for any damages that may
occur to customers’ personal computers (PC)
or other equipment. |
| 9.Customers
may connect multiple computers/devises within a
single home or office location to their DSL modem
and/or router to access the Service, but only through
a single DSL account and a single IP address from
Waverly Hall Telephone, LLC. |
